Ord. No. 2024-09. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AMERICAN CANYON TO MODIFYING THE COMPENSATION OF THE MEMBERS OF THE CITY COUNCIL

WHEREAS, pursuant to Government Code section 36516(a)(2)(a), on October 17, 2023, the City Council adopted Ordinance No. 2023-10 amending City Municpal Code Chapter 2.04.060 to set City Council monthly compensation at $950.

WHEREAS, Ordinance No. 2023-10 ordained the effective date for the increase in pay as November 6, 2024, after the next election cycle in accordance with existing law.

WHEREAS, as of November 26, 2024, the November 5, 2024 Election results have not been certified.

WHEREAS, December 7, 2024, is the beginning of the pay period following the anticipated December 3, 2024 Election results certification.

WHEREAS, City Ordinance No. 2004-01, adopted on August 19, 2004 established compensation for City Council Members when agenda items included matters related to the former American Canyon County Water District ("Water District").

WHEREAS, City Ordinance No. 2009-02, adopted on January 20, 2009 modified the compensation for City Council Members when agenda items included matters related to the Water District.

WHEREAS, consistent with City Ordinance No. 2024-08, adopting the City's Code of Conduct and Governance Protocols, the City Council no longer wishes to receive additional compensation for Water District matters.

NOW THEREFORE THE CITY COUNCIL OR THE CITY OF AMERICAN CANYON DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Chapter 2.04.060 of the Municipal Code shall be amended to provide (amendments in bold):

Section 2.04.060(A)(4) is amended to provide: Notwithstanding the effective date of the ordinance codified in this chapter, consistent with Government Code Section 36516.5, the salaries of the members of the city council shall not be increased to nine hundred fifty dollars per month until December 7, 2024.

Section 2. All previous ordinances concerning additional compensation for City Council members when agenda items include matters related to the Water District are hereby rescinded.

Section 3. This Ordinance shall be effective as of November 6, 2024.

Consistent with the California Environmental Quality Act (Public Resources Code Section 21000 et seq.) ("CEQA") and the Administrative Regulations Implementing CEQA (Title 14, Cal. Code Regs., Section 15000 et seq.) ("CEQA Guidelines") , the Board has determined that the adoption of this Resolution is not a "project" within the meaning of CEQA because pursuant to CEQA Guidelines Section 15378(b)(4) it involves only a government fiscal activity that does not involve any commitment to any specific project that may result in a potentially significant physical impact on the environment. The City Clerk or designee may file a Notice of Exemption with the Napa County Clerk within three (3) days following adoption of this Resolution.
