18.20.050 Action by planning commission and city council.
(A) The planning commission shall hold at least one public hearing on any tentative parcel map within sixty days of the date the application is deemed complete, unless this time period is extended by mutual consent of the subdivider and the community development director. The planning commission shall be notified of any extension of time agreed upon and the reasons for the extension.
(B) The planning commission shall determine whether a tentative parcel map is in conformity with the provisions of the Subdivision Map Act and of this title, the general plan and its elements, and
the zoning ordinance and upon that basis approve, conditionally approve, or disapprove said map, and shall report such action directly to the city council and the subdivider.
(C) The action of the planning commission on a tentative parcel map is final unless appealed to the city council or the city council, at the request of three of its members, desires to review the decision of the planning commission. Any appeal of a planning commission decision must be filed with the city clerk within ten working days of the decision being rendered. The city council must act to review the decision of the planning commission at the next regularly scheduled meeting of the city council.
(D) If the action of the planning commission is appealed to the city council or, the city council on the affirmative vote of three of its members desires to review the decision of the planning commission, a public hearing shall be held no later than thirty days after planning commission action on the tentative parcel map unless this time period is extended by mutual consent of the subdivider and the community development director and/or city manager. The city council shall be notified of any extension of time agreed upon and the reasons for the extension.
